By accessing or using the Website or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, forming a legally binding contract between you and the Company. If you are entering these Terms on behalf of an entity, you represent that you have the legal authority to bind that entity. If you do not agree to these Terms, do not access, browse, or use the Website or Services.

• Funded Account: An account using Company-provided capital for trading cryptocurrencies, with no personal funds deposited by the User.
• Trading Platform: Approved electronic interfaces (e.g., Phemex) for Funded Account trading.
• User Content: Blogs, comments, or other content submitted by a User for public display on the Website or Services.
• User Credentials: Unique email/username and password combinations for Account access.

The Services include:

• Beyond IQ Capital Challenge: A demo-based evaluation of cryptocurrency trading skills.
• Instant Funding: Direct access to Funded Accounts without evaluation.
• Funded Accounts: Trading with Company capital (up to $500,000+ for Elite accounts) in cryptocurrencies like BTC, ETH, USDT, and USDC.
• Tools: AI-powered indicators, performance analysis, and over 50 professional trading tools accessible via the Client Portal.

To order Services, complete the registration or order form on the Website. Upon registration, login details will be emailed to you. Fees vary by selected option and are non-refundable, even if you cancel your Account, terminate use prematurely, fail to meet Service conditions, or violate these Terms. Disputes or chargebacks with your bank may result in suspension or termination of Services.

You are responsible for obtaining compatible technical equipment and software at your own risk and expense. The Company does not guarantee compatibility with specific equipment or software. Trading platforms are operated by third parties with their own terms and privacy policies, which you must review and comply with.

Eligibility

You represent and warrant that you are at least 18 years old (or the minimum age required in your jurisdiction for permissible use of the Services). You must not have felony convictions, regulatory disciplines (e.g., CFTC), or outstanding debts to trading firms. You are responsible for ensuring compliance with all applicable laws. Cryptocurrency Trading Disclaimer

Cryptocurrency trading involves significant risks, including price volatility, liquidity issues, regulatory changes, and potential total loss of capital. Funded Accounts use Company capital, and you deposit no personal funds, bearing no financial loss beyond forfeited Rewards. Past performance does not guarantee future results. Simulated results (e.g., Beyond IQ Capital Challenge) have limitations and may not reflect actual trading outcomes.

CFTC RULE 4.41: Hypothetical or simulated performance results have limitations. Unlike actual trading records, simulated results do not represent real trading and may under- or over-compensate for market factors like liquidity. No representation is made that any account will achieve similar profits or losses.

User Accounts

Trading financial instruments involves risk and is not suitable for all investors. Beyond IQ Capital does not provide investment advice. All decisions are your own. You may lose all or part of your capital. Please trade responsibly.

Prohibited Conduct

You may not engage in:

• Exploiting Service errors (e.g., price delays).
• Disruptive practices (e.g., spoofing, wash trading).
• Excessive or unrealistic trades.
• Off-market trades or slow data feeds.
• Manipulative trades (e.g., hedging across accounts).
• Violating terms or Partner Rules.
• Using AI or ultra-high-speed manipulation.
• Uncommercial strategies or circumventing restrictions.
• Trading for others or engaging in other abusive conduct.

Violations may result in removal of profits, trade deletion, account reset/closure, or bans without notice or refunds.

Third-Party Services

The Services may reference third-party platforms (e.g., Phemex). The Company is not responsible for third-party terms, conditions, or experiences. Review third-party policies before use, and access at your own risk.

Disclaimer of Warranties

THE SERVICES AND WEBSITE ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. The Company does not guarantee uninterrupted or error-free operation, freedom from viruses, or legality in any jurisdiction. Use is at your own risk.

Limitation of Liabilities

The Company is not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits or data, even if notified of such damages. Purchases and Payments

Service fees are set forth during the order process and are non-refundable. Payments are processed via third-party payment processors, subject to their terms. You represent that you are authorized to use the provided payment method. Errors in pricing or availability may be corrected, with refunds issued if payment is charged.

Promo Code Usage

Promo codes are single-use, personal, and non-transferable. Abuse, such as sharing, selling, or exploiting codes, is prohibited and may result in account termination. Additional restrictions may apply per promo code terms. Products that are limited to a one-time purchase per account (such as $1 new-customer promotions) will be excluded from payouts if they are acquired multiple times through the use of new or duplicate customer profiles.

Linking to Our Website

Linking to the Website is permitted if done fairly, legally, and without suggesting endorsement without our consent. We may revoke linking permission at any time.

Restricted Access and User Credentials
